1. About these terms
These terms govern your use of Qniya Cars. By signing in you confirm that you have read and accepted them.
2. Our role
Qniya Cars is a broker (intermediary) that introduces buyers to sellers. Qniya Cars is not the seller of any vehicle, does not own or inspect vehicles, is not a party to the sale contract between buyer and seller, and does not hold, receive or transfer the sale price or any other funds of the parties. Buyer and seller agree the price, inspection, payment and transfer of ownership between themselves.
Information in requests and offers is provided by users. Qniya Cars does not guarantee its accuracy or the condition of any vehicle. We recommend a periodic inspection (Fahas) and an independent check before you pay.
3. Accounts
You sign in with a mobile number you control. You must give accurate information and keep your account secure. We may suspend or remove accounts that break these terms or misuse the platform.
4. Requests and offers
Buyer requests are reviewed before they open. Sellers submit sealed offers during an offer window of about 48 hours, which we may extend once. Offers stay hidden from the buyer until the window closes. A buyer is free to accept one offer or none. Sellers must not contact buyers outside the platform before the deal terms are accepted.
5. The seller's duty of disclosure
The seller must describe the vehicle truthfully and completely: VIN, model year, specification origin, odometer reading, accident and repair history and photos that show the actual vehicle. The seller alone is responsible for the accuracy of this information and for any loss caused by concealing or misstating a defect.
6. Brokerage commission
The seller pays the platform a brokerage commission of 1% of the sale price, or 0.5% when the seller is subscribed to the Pro plan at the time of the sale, with a minimum of SAR 1,000 and a maximum of SAR 5,000 in both cases, plus value added tax where applicable. The seller reports the sale in the app, which shows the amount. The seller acknowledges that the platform acts as a broker between seller and buyer, is not a party to the sale contract, and does not receive the sale price.
The platform is owed a brokerage commission of 1% of the sale price, or 0.5% when the seller is subscribed to the Pro plan at the time of the sale, with a minimum of SAR 1,000 and a maximum of SAR 5,000 in both cases, for every vehicle the seller sells to a buyer introduced by the platform, whether the sale is completed on or off the platform, within 12 months of the introduction.
An introduction is any contact a buyer makes with the seller through the platform, and any offer that reaches a buyer through it.
The seller undertakes to tell the platform when the vehicle is sold. The commission is payable within 7 days of the sale against an electronic invoice. No commission is payable for sales covered by the launch waiver announced on the platform.
The seller undertakes to disclose the vehicle's condition, accident history and odometer reading truthfully, to confirm its availability when asked, and is solely responsible for the accuracy of that information.

يقر البائع بأن المنصة تعمل بصفة وسيط (سمسار) بين البائع والمشتري، ولا تكون طرفًا في عقد البيع ولا تقبض ثمن المبيع.
يستحق للمنصة عمولة وساطة (سمسرة) بنسبة 1% من ثمن البيع، أو 0.5% إذا كان البائع مشتركًا في الباقة الاحترافية (برو) عند البيع، بحد أدنى 1,000 ريال وبحد أقصى 5,000 ريال في الحالتين، عن كل مركبة يبيعها البائع لمشترٍ عرّفته المنصة به، سواء تم البيع داخل المنصة أو خارجها خلال 12 شهرًا من التعريف.
يُعد تعريفًا كل تواصل يجريه المشتري مع البائع عن طريق المنصة، وكل عرض يصل المشتري عن طريقها.
يلتزم البائع بإبلاغ المنصة عند بيع المركبة، وتُسدد العمولة خلال 7 أيام من تاريخ البيع بموجب فاتورة إلكترونية. لا تُستحق عمولة عن الصفقات المشمولة بإعفاء فترة الإطلاق المعلن في المنصة.
يلتزم البائع بالإفصاح الصادق عن حالة المركبة وحوادثها وقراءة العداد، وبتأكيد توفرها عند الطلب، ويتحمل وحده المسؤولية عن صحة بياناته.
7. Acceptable use
Do not post false requests or offers, collect other users' contact details for other purposes, spam users, or try to avoid the commission by concealing a sale that the platform introduced.
8. Liability
To the extent the law allows, Qniya Cars is not liable for the conduct of users, for the condition, price or legal status of any vehicle, or for losses arising from a transaction between users. Nothing in these terms limits liability that cannot be limited by law.
9. Governing law and changes
These terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes are subject to the competent Saudi courts. We may update these terms, and the version in force is the one shown here at the time you use the service.
